Federal judge blocks Kentucky's work requirement for Medicaid.

A federal judge ruled that the Trump administration acted in an “arbitrary and capricious” manner when federal officials approved Kentucky’s first-in-the-nation requirement that low-income people work or otherwise engage in their communities to qualify for the safety-net health insurance.

The decision by U.S. District Judge James E. Boasberg vacates that approval and sends the state’s proposal back to the Department of Health and Human Services for further review.

His action stems from a lawsuit filed in January by three organizations opposed to the profound changes in the insurance program for the poor. Since then, the administration has granted three more states permission to impose similar requirements.

This is the first successful use of the  “arbitrary and capricious” standard I've seen under Trump. There are a lot of changes they've made that could potentially meet that standard.

 

I wouldn't be surprised if they get this through one way or another, but at least they can't do it quite so easily.
